EIN Application Rejected? Common Form SS-4 Mistakes & How to Fix Them (2026)

If your EIN application was rejected, the cause is almost always a Form SS-4 error — wrong responsible-party details, a missing signature, or a fax that never reached the IRS. For non-residents, who must apply by faxing Form SS-4, IRS processing takes 4–8 weeks, so a rejection costs you another full cycle. The fix is straightforward: identify the error, correct it on a fresh SS-4, and resubmit — but never submit a duplicate “just in case,” because doubles trigger their own rejections.

What Form SS-4 Actually Is

Form SS-4 is the IRS application for an Employer Identification Number. An EIN is a US federal tax ID issued by the IRS that identifies your business for tax purposes — banks, payment processors like Stripe and PayPal, and Amazon all require one. US residents with an SSN can apply online and get an EIN instantly; non-residents without an SSN must fax or mail the paper SS-4, which is where most rejections happen.

The 7 Most Common SS-4 Mistakes

1. Responsible party errors (Line 7). The responsible party is the person who controls the LLC — and the IRS matches the name and tax ID you enter against its records. Non-residents often enter a passport number where the form expects an SSN/ITIN, or misspell the name relative to IRS records. If you have an ITIN, use it exactly as issued. ITIN processing itself takes 6–11 weeks, so apply early if you need one.

2. Missing signature and date (bottom of form). An unsigned SS-4 is automatically rejected. Sign, date, and include a daytime phone number — the IRS does call applicants to verify details.

3. LLC name doesn’t match state records (Line 1). Your legal business name on the SS-4 must match your Articles of Organization exactly, including “LLC” and punctuation. Even a small mismatch — “Epics Deals LLC” vs “Epics Deals, LLC” — can cause rejection.

4. Submitting a duplicate application. After weeks of silence, applicants fax a second SS-4 “to be safe.” The IRS sees two applications for the same entity and rejects both. Submit once, then follow up by phone before resubmitting.

5. Wrong entity type (Line 8a). A single-member LLC should indicate it’s a disregarded entity owned by an individual or foreign person; a multi-member LLC is a partnership by default. Checking the wrong box confuses processing and can trigger rejection.

6. Fax transmission failures. The IRS fax line for international applicants is notoriously busy. If your fax confirmation shows a failure or partial send, the application was never received — keep the confirmation page as proof of every transmission.

7. Applying before the LLC exists. The IRS verifies your entity against state records. If you fax the SS-4 before your Articles of Organization are approved, expect a rejection. Wait until formation is confirmed.

How to Fix a Rejected EIN Application

Step 1: Find out why. The IRS sends a rejection notice (often by mail or fax) explaining the issue. Read it carefully — “responsible party mismatch” and “duplicate application” need very different fixes.

Step 2: Correct a fresh SS-4. Don’t scribble corrections on the rejected form. Complete a new Form SS-4 with the error fixed, double-checking every line against your state formation documents and tax IDs.

Step 3: Resubmit once, by fax. Send a single clean fax and keep the transmission confirmation. Then wait — remember, 4–8 weeks is normal for faxed applications.

Step 4: Follow up by phone if it drags past 8 weeks. The IRS business tax line can check your application’s status. Have your LLC details and fax confirmation date ready.

Avoiding the Problem Entirely

Most rejections come from rushing. The reliable sequence is: form the LLC first, confirm state approval, gather exact legal names and tax IDs, complete the SS-4 carefully, fax once, and track it. Epics Deals includes EIN application support in our $130 + state fee formation package, and we’ve seen every one of these errors — getting the form right the first time saves you a two-month delay.

Frequently Asked Questions

How long does a faxed EIN application take for non-residents?
The IRS takes 4–8 weeks to process faxed SS-4 applications from applicants without an SSN. Online applications (SSN holders only) are instant.

Can I apply for an EIN online as a non-resident?
No — the IRS online EIN application requires an SSN or ITIN for the responsible party. Without one, you must fax or mail Form SS-4.

What happens if I submit two SS-4 applications?
The IRS may reject both as duplicates. Always submit once and follow up by phone before resubmitting.

Do I need an ITIN before applying for an EIN?
No. You can apply for an EIN as a non-resident without an ITIN by faxing Form SS-4. An ITIN (6–11 weeks processing) is a separate tax ID you may need for personal US tax filing.

Can Epics Deals get the EIN for me?
Yes — EIN application support is included when we form your LLC for $130 + state fee. We serve both non-resident and US-resident entrepreneurs.
